a) Eupe Corporation Berhad and/or any entities within its corporate group, including the holding company, subsidiaries, associated, related and affiliated companies as well as their subsidiaries, associated and affiliated companies, both local and international (collectively referred to as the ‘Eupe’) recognize each individual’s data privacy rights and are committed to complying with the Personal Data Protection Act 2010 including any amendments, revisions, or supplementary regulations thereto, which may be enacted or introduced from time to time (“PDPA”).
b) This Privacy Notice explains how we collect, process, use, disclose, transfer and store your Personal Data in connection with your interactions with us, including but not limited to your use of our website, inquiries, visits to our sales galleries, participation in our events, and any transactions or potential transactions with us (Hereinafter referred to as “Notice”).
2. DEFINITION
a) “Personal Data” shall have the meaning as ascribed in PDPA, including but not limited to the following:
Such information may include, but is not limited to, your full name, identification or passport number, gender, date of birth, residential and mailing addresses, contact details (including phone number and email address), nationality, marital status, details of children, occupation, employer, income range, and financial information related to property financing (such as the type of loan applied for);
Details of third parties relevant to your transactions, such as the name, identification number, and address;
Information relating to your race, ethnic origin, religious beliefs, health condition, biometric or any other data classified as sensitive under PDPA;
Such other information which is essential to enable Eupe to manage customer relationships, assess eligibility, comply with legal requirements, and deliver our services and products effectively.
b) We collect two types of personal data: Obligatory and Optional.
Obligatory data is what we absolutely need to provide you with our products and services; and
Optional data is additional information that helps us improve your experience, but is not mandatory for us to provide you with our products and services.
Obligatory and Optional data collected by us depends on the specific product or service you are interested in.
c) “You” and “Your” shall refer to yourself and such other person or companies represented by you of which you are providing the Personal Data.
3. SOURCES OF PERSONAL DATA
We collect and process Personal Data through a variety of means, which includes but is not limited to:
a) Information You Provide: This encompasses all information you voluntarily provide to us through any medium whatsoever, including but not limited to forms on our website, at our sales galleries, via email, via text messaging, via social media direct messaging, over the telephone, documents delivered to us prior to and during our contractual or pre-contractual dealing and through any other direct interaction;
b) Automated Collection: We collect information automatically through your use of our website;
c) Third-Party Sources: We may obtain information about you from publicly accessible sources.
4. CONSENT
By engaging with us and providing your Personal Data:
a) You hereby give your unambiguous consent for the collection, process, use, disclosure, transfer and storage of your Personal Data for the Purposes set out in this Notice; and
b) In the event you provide Personal Data of any third-party Data Subject (other individual(s) or companies represented by you of which you are providing the Personal Data) you expressly represent and warrant that you have obtained the necessary consent from such party for us to use their Personal Data in accordance with this Notice.
5. PURPOSES FOR PROCESSING YOUR PERSONAL DATA
We collect and process your Personal Data for specific, explicit, and legitimate purposes as required or permitted by law as follows:
a) We use your Personal Data primarily to provide the services you asked for and to manage our business. This includes everything from processing your application and providing information, to handling contracts, payments, and after-sales support;
b) To run and improve our business and to administer our website, our businesses, and for internal operational purposes. This includes activities like data analysis, auditing, fraud prevention, research and development, market analysis, and maintaining security;

d) For marketing, personalization, and business collaborations including sending you information about properties, products, events, customer engagement and offers, creating personalized ads, and working with trusted partners on joint promotions and loyalty programs. You can opt out of these communications at any time by contacting us at the information provided under Clause 10 hereinbelow;
e) For any other purposes that are related, ancillary, or incidental to the completion of the Purposes described in this Notice, or as is otherwise necessary in the conduct of our businesses.

6. DISCLOSURE AND TRANSFER OF PERSONAL DATA
In order to efficiently conduct our business operations and deliver our services, your Personal Data may be disclosed and transferred within Eupe, strategic business partners, joint venture entities, service/ utilities providers, professional advisors, IT and data hosting providers, legal firms, auditors, marketing and communications agencies, banks and financial institutions, regulatory and governmental authorities, and prospective buyers in the event of a merger or acquisition, contractors, sub-contractors of Eupe or third party service or product providers as may determine to be necessary or appropriate, third party property, management companies/entities in respect of the management of property all of whom are bound by stringent confidentiality and data protection obligations.
7. YOUR RIGHTS AS A DATA SUBJECT
Under the PDPA, you have the following rights regarding your Personal Data:
a) Right of Access: You may request access to Personal Data we hold about you;
b) Right to Correction: You may request the correction of any inaccurate or incomplete Personal Data or request to update your Personal Data;
c) Right to Withdraw Consent: You may withdraw your consent to process your Personal Data for specific purposes, such as direct marketing, at any time;
d) Right to Limit Processing: You may request us to limit the processing of your Personal Data in certain circumstances;
e) Right to Data Portability: Where applicable, you may request that we transfer your Personal Data to another Data Controller in a commonly used machine-readable format; and
f) Cross-Border Data Transfer: such transfer shall only be carried out with your explicit consent and on the condition that the receiving jurisdiction maintains data protection laws that are substantially equivalent to the PDPA.

1. PENGENALAN
a) Eupe Corporation Berhad dan/atau mana-mana entiti dalam kumpulan korporatnya, termasuk syarikat induk, anak-anak syarikat, syarikat berkaitan, bersekutu dan berafiliasi serta anak-anak syarikat mereka, syarikat berkaitan dan berafiliasi, sama ada dalam atau luar negara (secara kolektif dirujuk sebagai “Eupe”) mengiktiraf hak privasi setiap individu dan komited untuk mematuhi Akta Perlindungan Data Peribadi 2010 termasuk sebarang pindaan, semakan atau peraturan tambahan yang dikuatkuasakan dari semasa ke semasa (“PDPA”).
b) Notis Privasi ini menerangkan bagaimana kami mengumpul, memproses, menggunakan, mendedahkan, memindahkan dan menyimpan Data Peribadi anda berhubung dengan interaksi anda bersama kami, termasuk tetapi tidak terhad kepada penggunaan laman web kami, lawatan ke galeri jualan kami, penyertaan dalam acara kami, sebarang pertanyaan serta sebarang urus niaga atau potensi urus niaga bersama kami (selepas ini dikenali sebagai “Notis”).
2. DEFINASI
a) “Data Peribadi” mempunyai maksud seperti yang diperuntukkan di bawah PDPA, termasuk tetapi tidak terhad kepada perkara berikut:
Nama penuh anda, nombor kad pengenalan atau nombor pasport, jantina, tarikh lahir, alamat kediaman dan alamat surat-menyurat, maklumat untuk dihubungi (termasuk nombor telefon dan alamat e-mel), kewarganegaraan, status perkahwinan, maklumat anak-anak, pekerjaan, majikan, julat pendapatan, serta maklumat kewangan berkaitan pembiayaan hartanah (seperti jenis pinjaman yang dipohon);
Maklumat pihak ketiga yang berkaitan dengan urusan anda, seperti nama, nombor kad pengenalan dan alamat;
Maklumat yang berkaitan dengan bangsa, asal usul etnik, kepercayaan agama, keadaan kesihatan, data biometrik, atau sebarang data lain yang diklasifikasikan sebagai data peribadi sensitif di bawah PDPA;
Maklumat-maklumat lain yang berkaitan untuk membolehkan Eupe mengurus hubungan pelanggan, menilai kelayakan, mematuhi keperluan undang-undang, serta menyediakan perkhidmatan dan produk kami dengan berkesan.
b) Kami mengumpul dua jenis data peribadi: Data Wajib dan Data Pilihan:
Data Wajib adalah maklumat yang kami perlukan secara mutlak untuk menyediakan produk dan perkhidmatan kepada anda;
Data Pilihan adalah maklumat tambahan yang membantu kami meningkatkan pengalaman anda, tetapi tidak diwajibkan untuk kami menyediakan produk dan perkhidmatan kepada anda.
Data Wajib dan Data Pilihan yang dikumpul oleh kami bergantung kepada produk atau perkhidmatan khusus yang anda minati.
c) “Anda” merujuk kepada anda berserta mana-mana pihak ketiga sama ada individu atau syarikat yang diwakili oleh anda di mana Data Peribadi mereka dikemukakan kepada kami.
3. SUMBER DATA PERIBADI
Data Peribadi anda dikumpul melalui pelbagai cara termasuk tetapi tidak terhad kepada:
a) Maklumat yang Anda Berikan: Termasuk semua maklumat yang anda berikan secara sukarela melalui sebarang medium, termasuk borang atas talian, semasa lawatan ke galeri jualan, melalui e-mel, pemesejan teks, pemesejan langsung media sosial, telefon, dokumen yang dihantar sebelum dan semasa urus niaga atau potensi urus niaga, dan melalui sebarang interaksi dengan Pihak Eupe;
b) Pengumpulan Secara Automatik: Apabila anda menggunakan laman web kami;
c) Sumber Pihak Ketiga: Kami mungkin memperolehi maklumat mengenai anda daripada sumber yang boleh diakses secara umum.
4. PERSETUJUAN
Dengan berurusan dengan kami dan memberikan Data Peribadi anda:
a) Anda dengan ini memberikan persetujuan yang jelas dan nyata bagi pengumpulan, pemprosesan, penggunaan, pendedahan, pemindahan dan penyimpanan Data Peribadi anda untuk Tujuan seperti yang dinyatakan dalam Notis ini; dan
b) Sekiranya anda memberikan Data Peribadi pihak ketiga (individu atau syarikat lain), anda secara nyata mengesahkan bahawa anda telah memperoleh persetujuan yang sah daripada pihak tersebut untuk kami memproses Data Peribadi mereka selaras dengan Notis ini.
5. TUJUAN PEMPROSESAN DATA PERIBADI ANDA
Tujuan pengumpulan Data Peribadi anda adalah bagi tujuan-tujuan berikut dan ianya termasuk:
a) Bagi tujuan penyediaan perkhidmatan seperti yang diminta oleh anda serta menjalankan segala urusan perniagaan Eupe, termasuk pemprosesan dokumentasi, penyampaian maklumat, pengurusan kontrak, pemprosesan pembayaran, dan perkhidmatan sokongan selepas jualan;
b) Untuk pentadbiran dan operasi perniagaan kami dan laman web kami, termasuk analisis data, audit, pencegahan penipuan, penyelidikan dan pembangunan, analisis pasaran serta keselamatan sistem;
c) Untuk mematuhi obligasi perundangan dan kawal selia dibawah PDPA dan undang-undang yang berkaitan termasuk mematuhi arahan pihak berkuasa atau agensi kerajaan;
d) Untuk tujuan pemasaran, kerjasama perniagaan, menghantar maklumat berkaitan hartanah, acara-acara Eupe, aktiviti interaksi pelanggan, atau produk, pengiklanan peribadi serta program kesetiaan dengan rakan kongsi. Anda boleh menarik balik persetujuan ini pada bila-bila masa dengan menghubungi kami menurut maklumat di Seksyen 10; dan
e) Untuk apa-apa tujuan lain yang berkaitan atau berbangkit daripada Tujuan seperti yang dinyatakan di atas.
(Tujuan-tujuan ini secara kolektif dirujuk sebagai “Tujuan”)
6. PENDEDAHAN DATA PERIBADI
Bagi membolehkan kami menjalankan operasi perniagaan dan penyampaian perkhidmatan seperti yang diminta oleh anda, Data Peribadi anda boleh didedahkan dan dipindahkan kepada entiti dalaman Kumpulan Eupe, rakan perniagaan strategik, entiti usaha sama, penyedia perkhidmatan, penasihat profesional, penyedia IT, firma guaman, juruaudit, agensi pemasaran dan komunikasi, bank, institusi kewangan, pihak berkuasa kawal selia, pembeli berpotensi (sekiranya berlaku penggabungan atau pengambilalihan), kontraktor dan subkontraktor yang dilantik oleh Eupe atau entiti pengurusan hartanah yang berkaitan di mana kesemua pihak ini tertakluk kepada obligasi kerahsiaan dan perlindungan data.
7. HAK ANDA SEBAGAI SUBJEK DATA
Di bawah PDPA, anda mempunyai hak-hak berikut:
a) Hak Akses: Anda boleh meminta akses kepada Data Peribadi yang kami simpan mengenai anda;
b) Hak Pembetulan: Anda boleh meminta pembetulan terhadap sebarang ketidaktepatan atau kemas kini Data Peribadi anda;
c) Hak Menarik Balik Persetujuan: Anda boleh menarik balik persetujuan anda terhadap pemprosesan untuk tujuan tertentu, seperti untuk tujuan pemasaran;
d) Hak Mengehadkan Pemprosesan: Anda boleh meminta agar kami mengehadkan pemprosesan dalam keadaan tertentu;
e) Hak Keboleh-alihan Data: Jika berkenaan, anda boleh meminta pemindahan Data Peribadi anda kepada Pengawal Data lain; dan
f) Pemindahan Data Rentas Sempadan: Hanya akan dilakukan dengan persetujuan nyata anda dan tertakluk kepada jaminan bahawa negara penerima mempunyai undang-undang perlindungan data yang setara dengan PDPA.

8. PERLINDUNGAN DATA PERIBADI
Data Peribadi anda adalah penting kepada kami, dan kami komited untuk memastikan ia disimpan dan diproses dengan selamat. Kami akan melaksanakan langkah-langkah pentadbiran dan keselamatan yang sesuai, prosedur, dan dasar, sejauh yang praktikal dan mengikut undang-undang yang berkaitan, untuk mengelakkan pemprosesan yang tidak sah atau menyalahi undang-undang, serta melindungi daripada kehilangan, kemusnahan, atau kerosakan secara tidak sengaja terhadap Data Peribadi anda pada setiap masa.
9. PENYIMPANAN DATA PERIBADI
Data peribadi anda akan disimpan untuk tempoh yang diperlukan bagi memenuhi tujuan yang dinyatakan di atas. Apabila data tersebut tidak lagi diperlukan untuk tujuan berkenaan, kami akan mengambil segala langkah munasabah untuk memadam atau menyamarkan data tersebut dengan selamat mengikut undang-undang dan peraturan yang berkuat kuasa.

12. KESAN TIDAK MEMBERIKAN DATA PERIBADI
